VPX Prevails Over Red Bull in France


Popular energy drink, Red Bull tried to be the ca-bosh on VPX’s energy drink, Redline from coming into France. Aside from the word “red” I have to side with VPX on this one.

WESTON, FLORIDA JUNE 25, 2010 – Dietary and nutritional supplement company Vital Pharmaceuticals, Inc., d/b/a VPX/Redline of Weston, Florida, announces today that it prevailed against Red Bull GmbH Societe De Droit, Austria (“Red Bull”) in a French Trademark Opposition Proceedings for Redline Trademark. Red Bull brought the Opposition Proceedings in France against the VPX/Redline trademark application on or about March 15, 2010 in the European Union Office for Harmonization in the Internal Market (Trade Marks and Designs (“OHIM”) citing to dilution and likelihood of confusion.

While Red Bull has been successful with opposition proceedings in other countries, the French Trademark Office has rejected Red Bull’s contention that there was a risk of confusion between the Red Bull and Redline trademarks, stating that there was no likelihood of visual and/or intellectual signs of confusion in France. The news of this legal victory comes on the heel of future plans by VPX/Redline to offer its Redline in other geographical regions. The freedom to conduct business in France gives greater position to the Redline brand in the market.
